Civil Law and Litigation

Contractual breaches, damage claims, and disputed debts require a thorough legal assessment and a clear course of action. We represent businesses and entrepreneurs in civil and commercial disputes, developing a legal strategy that aligns the pursuit of their rights with their commercial objectives and the practical implications of each available course of action.

Pursuing and defending claims

We represent clients in contractual disputes, warranty matters, damages claims, and the enforcement or defense of monetary claims. This includes disputes arising from supply agreements, business collaborations, and other commercial relationships, both domestic and cross-border.

Choosing the right path to resolution

We begin by assessing the legal position, available evidence, and potential costs. Working closely with you, we evaluate whether commercial mediation or litigation is better suited to the dispute. Key considerations include the prospects of success, time and cost implications, the enforceability of a judgment or settlement, urgency, confidentiality, and the importance of preserving business relationships. This assessment provides the basis for deciding whether to pursue an amicable resolution or enforce or defend your rights through the courts.

Strategic litigation focused on what matters

We analyze the facts, identify the key legal issues, and develop a litigation strategy tailored to your case and objectives. Throughout the proceedings, available options are discussed with you to ensure that each decision is informed and purposeful. Where claims or evidence are at risk, appropriate protective measures are assessed. Commercial mediation remains an option throughout the process whenever it offers a practical path toward resolving the dispute.

Understanding contracts and the commercial context

Drawing on extensive experience in contract law, corporate law and transactions, we assess complex business relationships from both a legal and commercial perspective. Contracts, business processes, and supporting documentation are examined to identify the issues most relevant to the dispute. For cross-border matters, we coordinate with our established network of international law firms where appropriate.

Does litigation make commercial sense?

Whether litigation is worth pursuing depends on the specific circumstances of the case. We carefully evaluate the prospects of success, available evidence, anticipated legal costs, the likelihood of recovering any amount awarded, and the time involved. These factors are weighed against the potential benefits of an amicable resolution. Together, we assess whether commercial mediation, an out-of-court settlement or court proceedings offer the most effective way to protect your interests.

Legal representation and mediation are strictly separate. If the firm has previously advised or represented a party in the same dispute, an independent mediator will conduct the mediation. Any ongoing legal representation is handled separately, preserving the mediator’s impartiality and the integrity of the mediation process.

Personal consultation

Whether you need to pursue a claim or have received a lawsuit or payment demand, we will assess your legal position and help you determine the most appropriate course of action.
